The Herb House is located at Beaulieu Road, Lyndhurst, Hampshire, SO43 7FZ by Lime Wood Group Ltd, Hawkslease, Chapel Lane, Lyndhurst SO43 7FG Company number 03811108.

These Terms and Conditions are between “Lime Wood Group”, the “Herb House” or “us”/”our” and “you”/the “applicant”/“member”/“guest” and are legally binding on you.

The Herb House have produced these “Terms and Conditions” to ensure that all guests of the Herb House are assured of the best possible and safest experience at every one of their visits. All members and guests of the Herb House are required to read, accept and adhere to the following Terms and Conditions, as well as to any other rules laid down by the Herb House from time to time. If you do not agree with these Terms and Conditions for use of the Herb House facilities then you will not be allowed to enter the Herb House.

The Herb House Spa complex is open to members, guests, residents of Lime Wood Hotel and other persons at the Herb House’s sole discretion. The Herb House reserves the right to amend these Terms and Conditions at its sole discretion with or without notice to you. For your information, this current version of the Terms and Conditions is dated October 2024. 

The Herb House cannot, in any way guarantee the availability of a particular therapist or the efficacy of a treatment.

MEMBERSHIP APPLICATIONS & FEES

All applicants for the Herb House membership must be over 18 years old and apply via our website.

In order to monitor membership numbers, the Herb House have created a membership committee who will review your application.

The membership committee reserves the right to decline an application for membership without giving any reason for doing so. For the avoidance of doubt no money is taken until full membership has been granted. Where membership is at full capacity, once your application is accepted, your details will be added to a waiting list and you will be contacted once a suitable space becomes available for membership.

The Herb House membership committee will periodically review its membership and joining structure and fees. Membership applications can be for single or joint memberships. For any new members joining or members who have left and wish to return, the membership rate may be amended - please check the website for the latest membership fees. The Herb House offers a lifetime promise on its existing members’ fees, so provided the membership is uninterrupted, the fee payable will not change for the duration of the membership, despite the fact that new higher fees may be introduced for new members. This excludes any variation in the VAT rate (currently at 20%) or any other tax imposed.

Once your membership has been approved and notified to you, in order to secure your membership, a one-off non-refundable joining fee is due. This joining fee is payable upfront in advance by credit or debit card (the Herb House accepts Amex, Mastercard, Visa and Apple Pay. We do not accept any other cards including PayPal). If membership is cancelled, the joining fee will be payable again on renewal of a new membership. For the avoidance of doubt, you will not receive your membership until the Herb House has received cleared payment.

Please bring the following with you to the induction:

  • One form of ID eg Passport or Driving Licence

Please bring originals of the ID which will be verified by our membership team at your induction. A photo will be taken of you at your induction.

The membership fees are payable annually upfront or divided by 12 and paid monthly by direct debit. Monthly fees will be debited on or just after the 1st of the month by direct debit.

Members will only be permitted to use the Herb House facilities provided that their membership is current and fully paid up. Once a membership expires or is terminated, any outstanding or unused guest passes or offers will expire from the date of termination or expiry of the membership.

Any changes in a member’s personal details must be communicated to the Membership team in writing as soon as possible but in any event within 2 weeks of any change.

MEMBERSHIP TERMS & CANCELLATION POLICY

Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 if you applied for your membership online (as opposed to in person) you have fourteen (14) days cooling-off period from the day you submitted your membership to cancel your membership in writing. If your membership is accepted within this time frame, your monies are received by the Herb House and you use the Herb House facilities you will be asked to pay a prorated fee for the use of our facilities. If you did not use our facilities and you paid the Annual membership fee we will give you a full refund within thirty (30) days after acceptance of your written cancellation.

ANNUAL PAYMENT MEMBERSHIP

Memberships carry a minimum membership period of 12 months. Annual memberships automatically come to an end when the initial 12 month period is completed. Annual members will be contacted 14 weeks prior to the end of their contract to confirm if they would like to renew their membership on a further annual basis or whether they would like to switch to monthly direct debit. Annual memberships must be renewed within two (2) weeks prior to the end of the 12 month term to secure the lifetime membership rate. If the membership is not renewed prior to the initial 12 month term expiring, the current membership rate would apply.

MONTHLY PAYMENT MEMBERSHIP

Memberships paid for by monthly direct debit automatically roll on monthly after the initial 12 month term ends. In order to cancel your monthly membership all members must give a minimum 3 full months written notice via email to the email address Membership@herbhousespa.co.uk with the heading “Cancellation”.

The 3 full months written notice can be given at any time during the 12 months term but notice must be given no later than 9 months before the end of the 12 months otherwise further monthly payments will be taken. For the avoidance of doubt, despite the time the 3 full months written notice is given, all monthly payment members must complete a full 12 months paying membership. Memberships can only be cancelled from the 1st of month. 

Notice can be given at any point during the month, but 3 full complete months membership fees must be completed following the written cancellation notice being given. The Herb House reserves the right to enforce a penalty if the contract is breached without 3 full months written notice within the 12 month period. It is the responsibility of the member to cancel their monthly direct debit with their bank after the 3 full month notice period expires. If any direct debit payments fail, the management reserves the right to levy an administration charge and recover the full payment due and costs from the member, this can include court action and debt collection.

Membership is only refundable under exceptional medical circumstances and at the discretion of the Herb House membership committee.

MEMBERSHIP SUSPENSIONS

Membership suspensions are available for members paying by monthly direct debit only. Memberships can be suspended for a minimum of 3 months and a maximum of 6 months within a 12 month period.

Within the first 12 months of joining, if you suspend your membership, the suspension period will be added to your initial 12 month term.

For example, if your membership commences on 1st Jan 2024 and you suspend for 3 months from 1st March – 1st June, your initial membership term will be extended until 31st March 2025.

Suspension for 3-6 months can only be granted once in a 12 month period.

Members cannot cancel their membership whilst they are in their suspension period, there must be 3 full months written notice once their membership is re-activated.

To request to suspend your membership, please inform us via email at Membership@herbhousespa.co.uk with the heading “Suspension of membership” by the latest 15th of the month prior to the start of your suspension. Suspensions can only be organised for complete calendar months.

Suspending your membership allows you to hold your membership rate at your joining rate, which has a lifetime promise. Your monthly direct debit must remain active (although no payment will be taken) throughout the suspension period and your membership fee will then be reactivated at the end of your suspension period.

ALTERATIONS TO MEMBERSHIP

If you would like to switch from a single to a joint membership, your membership rate would switch to the appropriate single or joint rate current at the time of the switch.

TYPES OF MEMBERSHIP

SINGLE MEMBERSHIP

Entitles one person use of the Herb House’s facilities during opening hours. The facilities a member is entitled to use will vary according to the type of membership the members has signed up for.

JOINT MEMBERSHIP

Entitles two members to use of the Herb House Spa facilities during opening times. The facilities a members is entitled to use will vary according to the type of membership the member(s) has signed up for. Joint members must reside at the same address. The lead member is responsible for all joint membership fees and fees must be paid from one bank account. However, both members are jointly and severable liable for any payments/ membership fees. Both members are liable for payment/ membership fees regardless of the name on the payment account.

CLUB MEMBERSHIP

Entitles a member full access to the Herb House gym and spa facilities, except the Workout Studio and classes. Club members are not entitled to Little Nippers swimming.

ALL ACCESS MEMBERSHIP

Entitles a member full access to the Herb House gym, spa facilities and classes, as well as Little Nippers swimming.

FULL WORKS MEMBERSHIP

Entitles a member full access to the Herb House gym and spa facilities & classes. Full Works Members are entitled to Little Nippers Swimming. Full Works Membership includes 4 Personal Training sessions per calendar month. These training sessions must be booked and taken within each calendar month on a use it or lose it basis. The Personal Training sessions cannot be transferred to another calendar month, are non-transferrable to other members and will expire with the expiry of the membership.

Full Works members includes a quarterly treatment on a use it or lose it basis. The member will be issued with a quartertly treatment credit with an expiry date.  The member must use the voucher before the expiry date. Each voucher entitles the member to enjoy a 60-minute treatment of their choice up to a set value. This voucher may only be redeemed once, may not be exchanged for cash. Booking is subject to availability.

Full Works members receive an annual dinner voucher to spend in Hartnett Holder & Co. This includes a 3-course dinner for 2 with wines chosen by our sommelier at HH&Co*

MEMBERS DISCOUNTS

All members receive the following discounts whilst their membership is active:

  • 10% off all treatments at the Herb House, subject to availability (please book in advance and mention your membership at the time of booking).  This excludes gift vouchers, which will be charged at full monetary value
  • 10% off all Food & Beverage in hotel, subject to availability (please book in advance and mention your membership at the time of booking).  This will be limited to up to 10 guests dining. Payment must be made by the member & membership must be valid at the time of payment. Please kindly note that member’s discounts will not be available for set-price packages such as Christmas Stays, Christmas Day Lunch, New Year's Eve, Smoked & Uncut, and similar offerings.
  • 10% off hotel rooms subject to availability (please book in advance and mention your membership at the time of booking).  This applies to rack rate only, Monday – Thursday excluding Bank Holidays only, up to a maximum of 4 rooms. No other discounts apply)
  • 10% off all retail purchases (excluding sale items)

GUESTS

All guest passes are valid for 12 months from date of issue.

Some memberships include guest passes or the option to purchase guest passes yearly at a discounted rate. Members may bring one guest per guest pass into the Herb House Spa. For the comfort of our members, the number of guests using the Herb House Spa at any one time will be restricted and guest places must therefore be booked in advance and are on a first come first served basis. The Herb House reserves the right to refuse entry to guests at its sole discretion. All guests will be required to announce their arrival at our reception.  Our terms and conditions are available for guests to review and accept in advance of using the facilities.

OPENING HOURS

The Herb House Spa opening hours may be subject to change. Last entry to the Herb House will be limited to within 30 minutes of the published closing time and the pool will close 15 minutes before the Herb House Spa’s published closing time.

GENERAL HERB HOUSE RULES

The Herb House is designated a no-smoking environment at all times this includes e-cigarettes.

Members and their guests are asked to refrain from making calls on their mobile phones or playing videos or music on devices anywhere within the Herb House, in order to maintain the peace and tranquillity of the spa. 

All mobile phones must be put on silent and the Herb House would please ask that members and guests step outside the Herb House to take any calls. Laptops can be used in Raw & Cured provided they do not cause disturbance to others.

For the sake of the privacy of the Herb House members and guests, no photography or videos are to be taken on the premises of other members or guests (including by use of a camera on a mobile phone or PDA). During our Little Nippers swim time sessions, we ask that no mobile phones are used around the Lap Pool to safeguard children.

No food or drink, alcoholic or otherwise, may be brought into and consumed at the Herb House. Only food and drink purchased from Raw & Cured (or any other named restaurant on the Herb House premises) may be consumed on the Herb House premises.

Animals of any description are not allowed anywhere in the Herb House Spa at any time. Except for Guide Dogs and Hearing Dogs in or around the restaurant area, Spa and pool subject to our prior notice.

Members join the Herb House for the level of service and privacy offered. Members and guests are, therefore, requested to respect the privacy of fellow members and guests to the Herb House and ensure their actions do not cause nuisance, annoyance or offence to those around them.

The Herb House does not tolerate abuse, whether verbal or physical and any abuse against our staff is taken very seriously. Members or guests abusing our staff will be removed from the premises, memberships revoked and we reserve the right to report any incidents to the police.

VALUABLES & LOST PROPERTY

Lockers are provided in the Herb House changing rooms for members' and guests’ belongings. Members are encouraged not to leave any valuable items in these lockers as the Herb House accepts no liability for the loss or damage to members’ or guest’s property.

All lost property found on the premises should be handed in at our reception. Items will be stored by the Herb House for 3 months and then if not claimed disposed of or donated to a local charity.

The Herb House provides lockers for daily usage only. Items left overnight will be removed and held in the Herb House for 3 months. If the property is not then retrieved within the 3 month period, it will be disposed of or donated to a local charity.

DRESS CODE

Guests are requested to wear correct attire in the Herb House at all times. This includes wearing swimwear in all pool & poolside areas, saunas and steam rooms. All guests and members will be provided with a Herb House robe and flip flops and towels on a complimentary basis. The Herb House recommends use of the robes and flip-flops throughout the venue. These are for use only within the confines of the Herb House itself. The robes and flip-flops are not to be taken away by either guests or members.

Casual attire, including Herb House robes, are acceptable in Raw & Cured or any other named restaurant, on the Herb House premises. All guests must wear correct footwear (for example trainers and vibrams) and clothing at all times in the Gymnasium and Workout Studio.

HEALTH & SAFETY & LIABILITY

Members and their guests are advised not to undertake any strenuous physical activities for which they might be medically unfit. Members and guests who have any reservation as to their physical condition are advised to have a medical checkup by their Doctor before embarking on any exercise.

All new members are obliged to undergo a short induction and fitness assessment, prior to exercising in the gym or the studio, with one of our fitness consultants. All members and guests will be asked to complete a medical disclaimer before embarking on any exercise within the Herb House.

It is the member’s and guest’s sole responsibility to bring to the attention of the Herb House any medical condition or changes to medical condition which may present a health risk when using any of the facilities or engaging in any activities at the Herb House. All members and guests are asked to advise the Herb House staff of any special physical requirements at the time of booking. Disabled access is provided via the main entrance, the lift in our reception and there is also a disabled bathroom on the ground floor. All facilities are open to disabled members and guests but there is no hoist for Herb House pools.

The Herb House management reserves the right to restrict access to certain facilities for health and safety reasons.

  • No food, glassware or crockery is to be taken into the poolside areas.
  • No running, jumping or diving in the pool is allowed.

Members and guests may not use the saunas or steam rooms if they have high or low blood pressure, heart disease, cardiac irregularities, asthma and/or diabetes, or if you are pregnant. Members and guests may not also use the saunas and steam rooms while under the influence of beta-blockers, anticoagulants, antihistamines or tranquillizers. Members and guests should consult their doctor prior to using the Herb House facilities. For health & safety reasons, members and guests must shower before entering the pool, sauna, steam rooms or wet areas.

All members and guests use the Herb House at their own risk and the Herb House does not accept any liability for any illness or injury which results from the use of the Herb House Spa’s facilities by members or guests. Members and guests warrant that they are and remain fit and able to use the facilities they are using at Herb House, including the Herb House Spa. A member and guest must notify us immediately if these circumstances change.

Nothing in these Terms and Conditions excludes or limits the Herb House liability for death or personal injury arising from the Herb House’s negligence, or fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

To the extent permitted by law, the Herb House will expressly not be liable to members and or guests for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with: use of, or inability to use, the Herb House facilities; or use of or reliance on any content displayed on the Herb House Website.

As a member or guest, please note that the Herb House will not be liable for, including but limited to:

  • loss of profits, sales, business, or revenue;
  • business interruption;
  • loss of savings or income;
  • any indirect or consequential loss or damage.

These limitations of liability apply even if the Herb House has been expressly advised of the potential loss. Nothing in this clause will exclude or limit any warranty implied by law that it would be unlawful to exclude or limit.

By using the Herb House facilities, members and guests agree that the exclusions and limitations of liability set out in these Terms and Conditions are reasonable. If the member or guest does not think they are reasonable, the member or guest must not use the Herb House facilities.

Any member or guest who suffers an accident on the Herb House premises must report the accident and circumstances under which it occurred to the Herb House Duty Manager, immediately following the accident.

FITNESS CLASSES

The Herb House publishes its fitness classes timetable but this may be changed at the discretion of the Herb House management via our website, newsletter and at our reception area. Access to classes is limited to All Access & Full Works members, hotel residents and spa days. Club members are not entitled to book classes at the Herb House. If you are eligible to book our fitness classes, you can book, change or cancel them on our MyWellness Fitness app, which can be downloaded onto your phone or tablet. For more information on our booking procedure for classes, please refer to our MyWellness booking procedure guide, a link for which is found in the electronic membership packs.

PERSONAL TRAINING

Personal Training sessions can be booked via the fitness team or at reception. Members can book individual Personal Training sessions. Please see the fitness page of the website for more information and rates.

PERSONAL TRAINER CANCELLATION

Cancellation with less than 24 hours via telephone or written notice via email Membership@herbhousespa.co.uk will incur a full 100% charge.

Any other greater notice periods a full refund will be given within one (1) week of notification.

CHILDREN

Only our All Access and Full Works Members are entitled to Little Nippers Swimming. Club Members are not entitled to Little Nippers Swimming. All Access and Full Works Members are entitled to bring their under 18 children to the Herb House to use the Lap Pool (only) during swimming hours (as listed below) at no extra charge. Members who would like to bring their under 18 year old children for a swim will need to register their Little Nippers at the time of joining on your intake form. Please refer to the Herb House Little Nippers Policy for more details of swimming times & terms of use. This is provided with your electronic membership pack and is also available on our website.

Once the member’s child turns 18, they would be eligible for our Adult Membership. Please ask the membership team for more information.

The Herb House ask that member parents ensure all children under the age of 3 years old are wearing neoprene nappies in & around the Lap Pool area in addition to a regular swim nappy. Neoprene nappies are an added precaution & help protect from germs. If you have forgotten or misplaced your reuseable neoprene nappy, they are available to purchase from our reception.

The Herb House does not provide lifeguard facilities at the Lap Pool.

Swimming hours for children in the Lap Pool can be found on our Little Nippers Policy and are bookable on the MyWellness app. The Herb House management reserves the right to change these times at any point at its sole discretion.

All children under 18 must accompanied by a member parent or member guardian at all times. Children must also be accompanied in the changing rooms and must be quiet whilst in this adult area.

There are no crèche facilities at the Herb House. It is the responsibility of the parent or guardian to keep their children under control at all times and asks their children to observe the peace and tranquility of the pool area. Save as set out in our liability clause the Herb House accepts no liability for the children(s) of the member or guest during their time in the Herb House venue.

No treatments are available for children under the age of 16. Limited treatments of manicure and/or a pedicure are available for children 16 years and above.

POOL USAGE

All members and guests using the Lap Pool do so at their own risk. Running, jumping and diving into the swimming pool are strictly prohibited. Water-based classes will take place at designated times in the Lap Pool, at which point the pool will be unavailable for swimming. These class times will be displayed on our website on the fitness page. It will be necessary for the swimming pool to be closed at certain times for maintenance. The Herb House management will endeavour to give members prior notice of these closures but are not obliged to do so.

TREATMENT BOOKINGS & CANCELLATIONS

The Herb House recommend that all treatments are booked in advance to avoid disappointment. Bookings are made directly with the Herb House Spa reservations and reception team. Debit/Credit card details will be taken at the time of booking to secure your treatment. The Herb House accepts Amex, Mastercard, Visa and Apple Pay. It does not accept any other cards including PayPal.

The Herb House advises members to arrive 30 minutes prior to your treatment time to allow you to change into your robe and flip-flops and for the Herb House to confirm your requirements. Please be aware that late arrivals may mean the Herb House have to reduce your treatment time.

It is vital that mothers-to-be advise the Herb House when booking as some treatments will not be suitable for pregnant women. No treatments are permitted within the first trimester (12 weeks), apart from manicures and pedicures, and use of the heat facilities is also not advised. Please check with your Doctor before booking treatments.

The following cancellation policies apply:

TREATMENTS

Cancellation with less than 24 hours via telephone or written notice via email reservations@herbhousespa.co.uk will incur a full 100% charge.

DAY SPA PACKAGES

Cancellation with less than 72 hours via telephone or written notice via email reservations@herbhousespa.co.uk will incur a full 100% charge. For any other greater notice periods a full refund will be given within one (1) week of notification.

TERMINATION OF MEMBERSHIP & ENTRY REFUSAL

Any member or guest who fails to comply with these Terms and Conditions and rules of membership or who in the sole opinion of the Herb House Spa Manager and/or General Manager of the hotel, behaves in a manner which is offensive to other members, guests or is disruptive to the character and reputation of the Herb House, may have their membership terminated immediately without notice or refund.

The Herb House management reserves the right to refuse entry to the Herb House without providing any reason for doing so. Any persons suspected of being under the influence of alcohol or illegal drugs will be removed immediately.

The Herb House management team may also terminate membership of any member by notice in writing if any fees owed by the member remain unpaid 30 days after the due date for payment.

MAINTENANCE WORK

The Herb House reserves the right to withdraw all or some of the facilities when required to carry out maintenance work. Facilities may be closed for maintenance, replacement, renovation, cleaning and emergencies without notice or compensation.

ASSIGNMENT

A member or a guest cannot assign any of these rights in these Terms and Conditions and any attempt is void. The Herb House may assign its rights to any of our affiliate’s subsidiaries, or to any successor in interest of any business associated with the Herb House. For the avoidance of doubt, member and guests and the Herb House are not legal partners or agents or employer/employees.

UNENFORCEABLE PROVISIONS

If any provision of these Terms and Conditions shall be unlawful, void, or for any reason unenforceable under applicable law, then that provision shall be deemed severable from these Terms and Conditions and shall not affect the validity and enforceability of any remaining provisions.

APPLICABLE LAW

These Terms and Conditions, its subject matter and its formation, are governed by English law. The Herb House and members and guest shall agree to that the courts of England and Wales will have exclusive jurisdiction in relation to these Terms and Conditions.

VARIATION TO THESE TERM AND CONDITIONS

The Herb House reserve the right to alter, add to or amend any of these Terms and Conditions, or to reassign these Terms and Conditions in the interests of the Herb House. Should any questions arise, whether provided for in these Terms and Conditions or not, our decision shall be final. No alteration, addition, amendment or waiver to or of these Terms and Conditions shall operate to release member or guest from these Terms and Conditions.

Please check these Terms and Conditions from time to time to take notice of any changes the Herb House make, as they are binding on you.

THIRD PARTIES

The Herb House and you agree collectively the Herb House and you do not intend that any of these Terms and Conditions will be enforceable by virtue of the Contracts (Rights of Third Parties) Act 1999 by any person not a party to it other than permitted assignees.

WAIVER

The Herb House’s failure to exercise any power given to it under these Terms and Conditions or to insist upon strict compliance with any obligation under it, nor any custom or practice of shall not constitute any waiver of any of it rights under these Terms and Conditions. Save where provided to the contrary in these Terms and Conditions, a waiver by the Herb House of any particular default by the member shall be in writing and shall not affect or impair the Herb House’s rights in respect of any subsequent default of any kind by the member, nor shall any delay by or omission of the Herb House to exercise any rights arising from any default by the member affect or impair the Herb House rights in respect of the said default or any default of any kind.
